TERMS OF SERVICE

These Terms of Service govern your use of www.amazingnatures.com.au and purchases made from Amazing Natures. In these Terms, “Amazing Natures”, “we”, “us” and “our” refer to the business identified in our Contact Information.

By accessing our website or placing an order, you agree to these Terms. If you do not agree, you should not use the website or place an order.

Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right or remedy that cannot legally be excluded, including rights under the Australian Consumer Law.

  1. ELIGIBILITY

You must have the legal capacity to enter into a binding agreement to place an order. If you place an order for another person, you confirm that you have their authority to do so.

You must provide current, complete and accurate billing, delivery and contact information.

  1. PRODUCT INFORMATION

We take reasonable care to ensure that product descriptions, photographs, ingredients, weights, strengths, pricing and availability information are accurate.

Honey is a natural product. Its colour, flavour, texture and consistency may vary between batches, and natural crystallisation may occur. These natural characteristics do not remove any rights you may have if a product is faulty, unsafe, materially different from its description or otherwise fails to meet a consumer guarantee.

Product photographs are provided to help illustrate the product. Packaging may be updated from time to time, but the product supplied must still match its material description.

Please read the product label, ingredients, storage directions and warnings before consumption. Honey must not be given to infants under 12 months of age.

Information provided on this website is general information and is not medical advice. Our food products are not intended to diagnose, treat, cure or prevent disease unless a specific claim is lawfully authorised and expressly stated. If you have a medical condition, allergy, dietary concern or uncertainty about using a product, seek advice from an appropriately qualified healthcare professional.

  1. ORDERS AND ACCEPTANCE

When you place an order, you are offering to purchase the selected products under these Terms. An automated order confirmation acknowledges that we have received your order; it does not necessarily mean that the order has been accepted.

An order is accepted when we send a dispatch confirmation or otherwise expressly confirm acceptance.

We may decline or cancel an order before dispatch on reasonable grounds, including:

• stock being unavailable;
• a genuine technical or pricing error;
• an address that our available carriers cannot service;
• suspected fraud or unauthorised payment; or
• a legal or regulatory restriction preventing supply.

If we cancel an order after payment has been taken, we will notify you and return the affected payment to the original payment method within a reasonable time.

  1. PRICES, TAXES AND SHIPPING CHARGES

Unless clearly stated otherwise, prices are displayed in Australian dollars.

We will display the total amount payable before you confirm payment, including applicable taxes and any unavoidable charges that can be calculated at that time. Delivery charges are calculated according to the delivery address and order value and will be displayed before payment is completed.

Discounts and promotional codes are subject to their stated conditions. Unless stated otherwise, promotional codes cannot be exchanged for cash or applied retrospectively.

If a genuine pricing error is identified before dispatch, we will contact you. You may confirm the order at the corrected price or cancel the affected order for a full refund. We will comply with any obligations that apply under Australian law.

  1. PAYMENTS

Payment must be made using a payment method available at checkout. Payments may be processed by Shopify or another authorised payment provider under that provider’s terms and privacy practices.

We do not guarantee that every payment method will always be available. An order may be delayed or declined if payment cannot be authorised or if further verification is reasonably required to prevent fraud.

  1. AVAILABILITY

Products are offered subject to availability. We will not knowingly accept payment for a product that we do not intend, or should know we will be unable, to supply within the agreed or a reasonable time.

If an item becomes unavailable after an order is placed, we will contact you and provide an appropriate solution, which may include a replacement accepted by you, cancellation of the affected item or a refund.

  1. SHIPPING AND DELIVERY

Shipping is governed by our Shipping Policy, which forms part of these Terms.

Delivery dates and carrier estimates are estimates unless we expressly agree to a guaranteed delivery date. We are not responsible for delays outside our reasonable control, but we will communicate material delays and provide an appropriate solution where required by law.

If we cannot supply an order within an agreed or reasonable time, you may be entitled to cancel the affected order and receive a refund.

  1. RETURNS, REFUNDS AND CONSUMER GUARANTEES

Returns, refunds and replacements are governed by our Return and Refund Policy and the Australian Consumer Law.

We do not generally accept change-of-mind returns for consumable food products. This does not affect your rights if a product is faulty, damaged, unsafe, incorrectly supplied, materially different from its description or otherwise fails to meet a consumer guarantee.

For a major product problem, the customer may be entitled to choose between a refund and replacement. Other remedies may apply to minor problems or consequential loss as required by law.

  1. ORDER CHANGES AND CANCELLATIONS

Contact us as soon as possible if you need to change or cancel an order. We will try to assist, but we cannot guarantee a change or cancellation after processing or dispatch has begun.

A refusal of a change-of-mind cancellation does not affect any non-excludable consumer rights.

  1. ACCEPTABLE WEBSITE USE

You must not:

• use the website for unlawful or fraudulent purposes;
• attempt to interfere with the website’s security or operation;
• introduce malicious code;
• access another person’s account without authority;
• submit false payment, identity or delivery information; or
• copy or commercially exploit website content without permission.

We may restrict access where reasonably necessary to protect customers, the business or the website, or to comply with the law.

  1. INTELLECTUAL PROPERTY

Unless otherwise stated, the website’s text, branding, graphics, product photography, design and other original content are owned by or licensed to Amazing Natures.

You may use the website for personal shopping and information purposes. You must not reproduce, distribute, modify or commercially exploit protected content without written permission, except where permitted by law.

  1. THIRD-PARTY SERVICES AND LINKS

The website may use or link to third-party services, including payment providers, delivery carriers, social-media platforms and applications.

A third-party website or service may have its own terms and privacy practices. We are not responsible for independent third-party content or conduct, except to the extent responsibility cannot legally be excluded.

  1. WEBSITE AVAILABILITY

We aim to keep the website accurate, secure and available, but temporary interruptions may occur because of maintenance, technical problems or matters beyond our control.

We may correct errors or update website content. Changes will not remove rights relating to orders already accepted or consumer rights that cannot be excluded.

  1. LIABILITY

Nothing in these Terms limits liability or rights that cannot legally be limited under the Australian Consumer Law or other applicable legislation.

To the extent permitted by law, we are not responsible for losses that were not reasonably foreseeable, losses caused by a customer’s unlawful conduct or breach of these Terms, or losses caused solely by an independent third party outside our reasonable control.

This section does not exclude liability where doing so would be unlawful.

  1. PRIVACY

We handle personal information in accordance with our Privacy Policy and applicable privacy laws.

By placing an order, you acknowledge that information may be provided to service providers where reasonably necessary to process payments, prevent fraud, fulfil orders, provide support and operate the store.

Marketing communications will only be sent in accordance with applicable law, and customers may unsubscribe using the method provided in the communication.

  1. PROMOTIONS

Additional conditions may apply to competitions, discount codes, bundles, giveaways or other promotions. Those conditions will be made available with the promotion.

If promotional conditions conflict with these Terms, the promotional conditions apply only to that promotion. Consumer rights cannot be excluded by promotional conditions.

  1. CHANGES TO THESE TERMS

We may update these Terms to reflect operational, legal or regulatory changes. The updated version will display its effective date.

Updates apply prospectively. An order will generally remain subject to the version in effect when that order was placed, unless a change is required by law or agreed with the customer.

  1. GOVERNING LAW

These Terms are governed by the laws applicable in Australia and the state or territory in which Amazing Natures is legally established.

Nothing in this section removes any mandatory rights or protections available to a customer under applicable law.

  1. SEVERABILITY

If part of these Terms is found to be invalid or unenforceable, the remaining provisions will continue to apply to the extent permitted by law.
